1. Acceptance of Terms

By accessing or using ProbeX (the “Service”), you agree to these Terms of Service, our Privacy Policy, and our Acceptable Use Policy, which are incorporated by reference. If you do not agree, do not use the Service.

2. The Service

ProbeX provides tools that aggregate publicly available and third-party open-source intelligence (OSINT) for legitimate security research, fraud prevention, and investigative purposes. We may modify, suspend, or discontinue any part of the Service at any time.

3. Eligibility

You must be at least 18 years old and able to form a binding contract. By using the Service you represent that you meet these requirements and that your use complies with all laws that apply to you.

4. Lawful & Authorized Use Only

You are solely responsible for ensuring you have a lawful basis and proper authorization for every lookup you perform. You agree not to use the Service to:

  • Violate any law or regulation, including computer-fraud (e.g. the US CFAA), anti-stalking, anti-harassment, data-protection, or wiretap laws;
  • Stalk, harass, threaten, dox, defraud, blackmail, or harm any person;
  • Discriminate against any person or make decisions prohibited by the FCRA (see Section 7);
  • Gain unauthorized access to systems, accounts, or data;
  • Re-sell, redistribute, or build a competing database from the Service’s output, except as your plan expressly permits;
  • Circumvent rate limits, credits, or access controls, or scrape the Service.

You will indemnify and hold us harmless from any claim arising out of your use of the Service or your breach of these Terms.

5. Accounts & API Keys

You are responsible for safeguarding your credentials and API keys and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms, and we may revoke or rotate API keys to protect the Service.

6. Plans, Credits & Billing

  • Paid plans grant a monthly credit allotment and/or API access as described on the Pricing page. Credits are consumed per lookup and do not constitute money or stored value.
  • Unless stated otherwise, credits reset each billing cycle and do not roll over.
  • Paid subscriptions renew automatically each billing cycle until cancelled. You may cancel anytime from your account; access continues through the end of the paid period. Except where required by law, fees already paid are non-refundable.
  • We may change pricing prospectively with notice.

7. FCRA & Permissible-Purpose Restriction

ProbeX is not a consumer reporting agency and the data it returns are not “consumer reports” under the US Fair Credit Reporting Act (FCRA). You may not use the Service, in whole or in part, to make decisions about a person’s eligibility for credit, insurance, employment, housing, or any other purpose governed by the FCRA or comparable laws. By using the Service you certify you will not do so.

8. Intellectual Property

The Service, its software, branding, and original content are owned by us and protected by law. We grant you a limited, revocable, non-exclusive licence to use the Service per these Terms. Third-party data remains the property of its respective owners.

9. Disclaimers — Data Accuracy

THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Data is aggregated from public and third-party sources that we do not control; we do not warrant that any result is accurate, complete, current, or lawful for your intended use. You must independently verify information before acting on it. The Service is not legal, financial, or professional advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBEX AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM OR USD $50.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access for any breach of these Terms or the Acceptable Use Policy, or to comply with law. Sections that by their nature should survive termination will survive.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in New York County, New York, and you consent to that jurisdiction.

13. Changes

We may update these Terms; the updated version posts here with a new date. Continued use after changes constitutes acceptance.
